Bill Title: Civil Jury Trials - Amount in Controversy

Bill Summary: This constitutional amendment would authorize the General Assembly to raise the threshold at which a party may demand a jury trial in a civil action from $10,000 to $20,000. The effect of the change would be to transfer more suits from the Circuit Court to the District Court.

History: In 2009 SB 469 passed the Senate, but failed in the House Judiciary Committee.

Chamber Position: Oppose

Position Summary:Raising the threshold for demanding a jury trial would unfairly limit the rights of a defendant to a jury trial, and the discovery and motions process that defendants rely on in the Circuit Court. The effect of the change would be to inflate the damages requested of business defendants in District Court cases, thereby increasing the potential liability, damages and insurance costs of businesses.
