Bill Summary: This bill requires, if a covered employee receives additional compensation for a specified award for permanent partial disability, an employer or insurer to pay the additional compensation in a specified manner subject to a specified credit.

Position Summary: The Maryland courts have held that in all credit situations, whether as a result of a worsening of condition, or an increase or decrease in an award on appeal, weeks paid should be credited instead of dollars paid. In some cases, this works to the benefit of the employee. In others, a weeks credit works to the benefit of the employer. The Maryland Chamber opposes this bill because it unfairly disrupts the balanced approach taken by the courts.

For these reasons, the Maryland Chamber respectfully requests that the Economic Matters Committee give House Bill 1150 an unfavorable report.
