Bill Summary:
This bill would have prohibited the sale of a drug in Maryland after January 1, 2012 unless the manufacturer operated a drug take back program for unused drugs. The program would have been subject to the approval of the state Department of the Environment, which could have imposed fees and daily fines on drug manufacturers for non-compliance.
History: In 2010 HB 648 received an unfavorable report from the Environmental Matters Committee.

Position
Summary: The Chamber opposed this bill because it would have increased the cost of drugs for Marylanders through an expensive take back program, while safe and effective alternative means of drug disposal currently exist. Over 90% of trace pharmaceuticals in the water result from patient use and excretion of medicines. Therefore, such a take back program would not meaningfully affect water quality. Proper disposal of drugs through household waste programs are effective. The take back requirements of this bill would appear to violate federal law, while imposing additional costs on consumers.
