Bill Title:
Courts - Jury Trials in Civil Actions - Amount in Controversy
Bill Sponsor(s):

Subject:
Civil Liability
Committee:
JUD
Bill Summary:
This bill would have raised the threshold at which a party may demand a jury trial in a civil action from $10,000 to $15,000, contingent on the passage of a constitutional amendment. The effect of the change would be to transfer more suits from the Circuit Court to the District Court.
History: In 2009 SB 469 passed the Senate, but failed in the House Judiciary Committee. In 2010 HB 436 passed the House, but was amended in the Senate. However, a companion Senate bill, SB 118 was enacted as Chapter 225.
Chamber Position: Oppose
Position
Summary: Raising the threshold for demanding a jury trial would unfairly limit the rights of a defendant to a jury trial, and the discovery and motions process that defendants rely on in the Circuit Court. The effect of the bill would be to inflate the damages requested of business defendants in District Court cases, thereby increasing the potential liability, damages and insurance costs of businesses.
