Bill Summary: This bil would prohibit the transfer or diversion of funds from the Transportation Trust Fund (TTF) to the General Fund, unless 1)The Governor declares the transfer necessary due to extraordinary financial circumstances; and 2)Legislation is enacted prior to the transfer or diversion that provides for repayment of the funds within 5 years after the transfer of diversion; with repayment commencing immediately.

History: In 2009 this bill (HB 140) received an UNF report by the APP Committee. In 2010 this bill died in the Appropriations Committee without a vote.

Position Summary: The Maryland Chamber supports this legislation because it is consistent with the Chamber's business agenda, which urges the legislature and the state to protect the funds currently in the Transportation Trust Fund, as well as those designated for the Fund. A healthy Transportation Trust Fund is essential to the productivity of Maryland's infrastructure, roads, bridges, highways, ports, and rail.
