Bill Summary: This bill would prohibit a person from retaining certain security code information from a credit or debit card following a transaction. If such information is unlawfully retained and a security breach occurs that requires the reissuance of the cards, the person responsible for the breach would be liable to reimburse the financial institution for the cost of reissuing the cards and other damages.

Position Summary: The Maryland Chamber opposes this bill because of the open-ended damages that would be imposed on businesses by the terms of the legislation. The agreements signed by card issuers already make provision for compensation in the event of card reissuance.
