Bill Summary: Prohibiting, on or before January 1, 2010, the manufacture, sale, or distribution of specified toys or child care articles containing bisphenol-A or specified phthalates; requiring a person to use the least toxic alternative and prohibiting a person from using specified carcinogens or specified reproductive toxicants when complying with the Act; providing for a penalty; defining terms; etc.

History: Similar to HB0883 by Del. Hubbard in 2007

Chamber Position: Oppose

Position Summary: Several business and industry groups oppose this measure based on its lack of scientific basis, potential economic impacts and difficulty in monitoring for compliance. Legislating what chemicals can be used/sold in the State will have an economic impact on consumers, businesses and even government in terms of sales and income tax revenue. There appears to be no scientically proven health hazard. The Maryland Chamber opposes the bill.
